We do not know where the word Ballad originated from, however it is thought to come from the French Ballade; which means song with a dance. Ballads are simple repeating rhymes, which often have a refrain, and they have been existent as far back as the 14th Century. They were written to be sung, as a majority of people were illiterate. Alternatively Ballads were written to be catchy and memorable; as minstrels went around singing them. Due to them being attractive, people who heard them kept them in mind. Due to this Ballads have been passed down through generations, and some are still around today. Modern day Ballad writers/singers use different techniques and skill. This could maybe be why theyre more popular and successful. Some lucrative modern day balladeers consist of Robbie Williams and Alicia keys; these are very well known names in the music industry. From these I have chosen to study Ballad, Porphyrias lover and Bishop Hatto. The first poem I have chosen to study is Ballad. This poem is of a young woman who falls in love with a man and devotes her life to him. However after he gets her pregnant he leaves her, alone, to bring up a fatherless child in a harsh and cruel society. Due to this we are given the impression that in the end she kills herself and her baby. I get the impression that the woman in this poem may have killed herself due to the pressure of society; as anything like this was unheard of. To have sex before marriage was outrageous and immediately people would obstracised from society and treated very ruthlessly. This show the societies was forbidden from breaking traditional laws, and were prohibited from having children or sexual relations before marriage; so had to remain virgins. The moral of the poem shows us that the poem was written a long time, as today people are not banned from society for being single mothers or losing their virginity before marriage. The poem indicates that it was written in the 17th Century as archaic language is used A faithless shepherd courted me The word courted is quite an unusual word to be used nowadays, so it is quite noticeable that this poem was written quite far back. As this poem is a Ballad, its typical features are included. The rhyming scheme for this poem is rhyming couplets and contains a chorus; the reason for this was that it had to be as memorable as possible so by including a chorus it was easier to remember. This was because people could not read so the easiest form of communication was song. This ballad uses repetition which is a typical feature of a ballad, I wish, I wish- but its in vain- I wish I was a maid again The repetition of those words gives it a choric effect. It also shows she regrets it a lot and she wants her virginity back. Those quotes also tell the reader that she has got strong feelings about the past. We know from line 7 that she had no experience with men, and that she did not have boyfriends When my poor heart was strange to men This line uses economical flow and allows us to know she had never been involved with men before. Poetic Fallacy is used too When summer bought no fear to fright He came to guard me every night When summer arrives everyone is happy, and it is a cheerful time and that is when he came. However when winter arrived he didntt come When winter nights did darkly prove None came to guard me or to love Winter is a depressing time, it a sad, gloomy time. The theme of the seasons is contrasted, however when she became pregnant he did not love her anymore. Also alliteration has been used When will green grass cover me? This line shows us she wants to die. The alliteration builds tension to the part it draws attention. It also manages to create rhythm and manages to show how desperate she is. Another part in the poem where the writer has used contrasting images is in lines 17-18 I wish my babe had neer been born; Ive made its pillow on a thorn The words pillow and thorn are contrasting images. A pillow is soft and comfortable whereas a thorn is sharp and dangerous. It tells the reader that the situation she has put herself in is very unstable for the baby, although the contrast is very simple; it is very effective because they are both such strong opposites. In line 21 He promised beds as fine as silk and sheets for love as white as milk We find out that he promised her lots of lust and passion, however towards the end of the verse Left me to want a bed of clay We find out that she wants nothing but death and she no longer wants sexual desire; a metaphor is used to make it more understandable and exaggerate the feelings a little His heart seemed soft but it was steel This verse tells the reader that he was nice to her but after she became pregnant, he didntt like her. It also creates an image and tells us the man was unable to love and show his true emotions. In addition I think it also suggests that his heart must me made of steel if he would leave her on her own to bring up a child. Finally in the end we get the impression that she has killed herself and her baby; I wish our sorrows away Our souls with god our bodies clay We do not know what happens but these two lines play on the readers emotions a lot as it keeps them in suspense. The main themes of this poem are sadness, betrayal, suffering, love, hatred and death. The second poem I studied was Porphyrias lover. In this poem Porphyrias Lover, the poet describes the speaker of this dramatic monologue as a man who lives in a cottage in the countryside. In a cold and windy night, his lover, Porphyria, comes to his cottage and lights a fire to keep them warm. The girl then talks of how she loves him. However, the man in this poem has a relatively low social state, since he talks about how Porphyrias struggles to set her passion free from pride. The speaker soon realized that Porphyria will eventually give in to the societys pressure, and he wants to keep her love to him forever. As a result of his possession the speaker strangles Porphyria to death, and then he sits with the corpse for the entire night. At the end he mentioned that he thinks God has not yet moved to punish him The social relevance of this poem is that people had affairs so this gives us the impression that this poem was not set long ago; maybe it was set in the 19th century. At the beginning of the poem pathetic Fallacy is used; to set the mood of the writing, The rain set early in to-night, The sullen wind was soon awake, It tore the elm-tops down for spite, This quatrain sets a negative scene and lets the reader know something is not right. This causes a lot of tension and it gives the impression something bad is going to happen. Also in the poem personification is used to create a negative atmosphere. The next line is the point where very cleverly, the poet manages to change the focus of attention of the reader to the lover without losing any of the effect that the imagery created so far: I listened with heart fit to break. This line shows that the lover was waiting desperately and has reached a certain degree of impatience when his beloved enters the sordid cottage. The room where the lover is waiting also signifies a certain level of sorrow that is caused throughout the poem. When Porphyria glides in she changes the mood When glided in Porphyria straight She shut out the cold and the storm From this line we know Porphyria meant a lot to the writer, and that she brings a lot of sense and warmth to him. Also when she enters the mood changes this clearly shows that Porphyria means a lot to someone. It is very strange as the poem shows the woman is called Porphyria; which is a sexually transmitted disease. This gives the impression that the name was used as a metaphor; maybe like a disease she could not be rid of and maybe caused a small level of unease too. The poem uses erotic language and is quite seductive: Which done, she rose, and from her form Withdrew the dripping cloak and shawl And laid her soiled gloves by, untied Her hat and let the damp hair fall It shows how keenly and decisively the poet was waiting for her that he noticed every single detail- as how she came in straight to him and how dearly Porphyria wanted to meet him. Moreover they also show that the girl is absolutely at ease with her beloved meaning there by that she felt completely at home. Furthermore the way in which she takes off her gloves, and then her hat all show that she meant to spend some time and was not in a rush, and that she felt comfortable with her lover. However as we read the poem the true side of the lover comes out. As soon as we read this line, we get a picture of a maniac; due to the repetition that is used. Also he states that killing someone is perfectly pure and good, and after this we indefinitely know that he is mad, as it is a horrific thing to kill someone. A simile is also used As a shut bud that holds a bee, I warily opened her eyes again This simile is used to describe Porphyrias closed eyes; they are being compared to a shut bud that captures a bee. Furthermore alliteration is used Blushed bright beneath my burning kiss When this sentence is pronounced the first three words create a beat, however not a normal beat but maybe the beat of a heart, however in this case the heart is not beating anymore; so maybe of a heartbeat that was there but isnt anymore. While reading Porphyrias Lover the main idea that stood out most in the poem was love. Also, an important part of this theme was the effects love may have on people such as fear, joy, pride, vanity, suffering, murder, death and obsession as demonstrated by the speaker. The theme of love appears to be simple, but is actually complex in this poem. Porphyrias Lover is not a sensitive love poem; it is a poem that shows what love can sometimes do to people. In the poem, the speaker describes feelings of fear and of heartache or heartbreak. The third ballad that we studied is Twa corbies. This ballad is one of the best known Scottish border ballads; it is of two ravens discussing were they will dine. They talk about a murdered knight and are unconcerned about the tragedy. They want to dine of the corpse. We are not too sure on when this was written, however we know that it was at the time of the war as it is based on a soldier who fought for the country. I wot there lies a new- slain knight Also the social relevance tells us that people who went to war were forgotten about, and were not cared about after the war. Twa Corbies does not contain many features of a ballad however it consists of quatrains As I was walking all alane I heard twa corbies making a mane The tane onto the tither did say Whar sall we gang and dine today? The ballad consists of four line stanzas which are short, with AA BB rhyme scheme. This was done so when it was sang people would learn it more easily and sing it over and over. Furthermore more it consists of language of the time; also as the language is Scottish it is a little harder to understand In behint yon auld fail dyke I wot there lies a new-slain knight; And naebody kens that he lies there But his hawk, his hound and his lady fair We discover in the end that the knight is left with nothing. His hawk, hounds and lady quickly forget him and his body is lost. He has left no legacy and in fact his body is subsumed by nature. Additionally it states he is a new slain knight so he hasnt been away for months; this revelation reinforces the feelings of desertion and futility. Instead of the knights family staying to protect and honour him after death the Ladys taen another mate Everyone that has ever meant anything to the knight deserts him and this shows us how selfish people were; they no longer care about respecting the knight when they have nothing to gain from the friendship. This makes the reader wonder how much he was loved in the first place. Repetition is used But his hawk his hound and his lady fair It is used to This ballad comes across as sad and cruel and describes the ravens as malicious; however they are merely following the laws of nature. The last section reminds the reader that no one will remember the knight now that he is gone, and also emphasizes that nature and living will not change with the death of one person. In the end, however, the ravens reveal that relationships that are significant, but the understanding that life is an unending cycle and an important part is death. The themes of this ballad are betrayal, selfishness and hopelessness, sadness, death and life. In conclusion all the poems I chose had similar themes, but one definite one was sadness. The first poem ballad was one I enjoyed very much. This was because there was a meaning behind each stanza and it seemed like there was true emotions behind the words. Also AA BB rhyme scheme was used which I found very and enjoyable to read. Also many poetic devices have been used which makes the poem more interesting and plays on the readers emotions and creates dramatic irony. The second poem Porphyrias Lover I thought was ok as the storyline was very dramatic and kept me interested. However the language was very complex and the storyline was a little confusing. Apart from that I enjoyed learning to use the poetical devices and seeing how they were used. Finally the last poem Twa Corbies I did not enjoy very much. This was because I did not find anything outstanding about it. Also as it is written in Scottish I found many words hard to understand. The one thing I did enjoy about it was when I heard it in audio as I thought it was very memorable. Lastly there are hardly any poetic devices so the ballad is not that effective or appealing.

Pop And Jazz Report Guidelines - Essay Example Saturday, the 25th day of June was the date when Darius Jones trio took to the podium to dazzle the crowd with their jazz pieces (Lavelle 12). The scene for the Undead Jazz Festival was spread across different venues throughout New York City. This was not a brilliant idea as there was confusion on where and when the individuals and groups would play with some missing out on the action due to this. Over fifty jazz groups braced the event much to the surprise of the organizers and eleven venues were picked for each night during this year’s festival. Le Poisson Rounge, Kenny‘s Castaways, Sullivan Hall was picked as the opening venue in Manhattan scheduled for June 23rd. The Bell House in Park Slope, Brooklyn hosted the events of June the 24th and Public Assembly, Cubana Social, Cameo Gallery in Williamsburg, Brooklyn hosted the events of June the 26th.Darius Jones trio was scheduled to perform at Littlefield, Homage Skate Park and cross fit gym in Gowanus, Brooklyn (Lavelle 23). The stage at Homage Skate Park training facility was improvised and the acoustics were not as brilliant as expected. Plenty of unwarranted reverb was experienced with an occasional echo and feedback. This did not stop the 3,500 people in attendance from enjoying the music. Both the young and old were in attendance here and the audience was multi disciplinary, with a little bit of everybody being present, from aspiring jazz musicians to renowned performers from different generations (Lavelle 67). Jazz was obviously the group’s music genre of choice, with a contemporary feel and I must say they did not disappoint. The group is made up of three musicians with Darius Jones on the saxophone, Jason Nazary on drums and Adam Lane on bass who are all professional musicians. Voice was not an instrument of choice during this performance (Lavelle 45). These musicians seemed to know their instruments pretty well as they showed considerable expertise and skill both in the music playe d and especially in the improvisation. Darius played a series of runs and drills flowing through the blue scale. The fact that he included modulation, crescendo and diminuendo in his play portrayed him as a gifted jazz musician and the audience seemed to agree (Lavelle 47). The bass player, Adam Lane was the backbone of the trio, playing the underlying bass ling that guided the improvisation, though he would wonder off at times before swiftly and accurately going back to his part. The drums were played almost perfectly with Jason Nazary dictating the tempo and incorporating different speeds in the music. The drums created the beginning of all the songs and picked turns in ending them with the alto saxophone creating the ending melody at times (Lavelle 36). The music was really enjoyable and had a complex groove though I still feel more could have been done to incorporate and create a cool mix of classical and contemporary jazz. The set became surprising due to the group’s wid e range of creativity. Jones playing the alto saxophone gave the enthusiastic audience a taste of firm, earth bound music while exploring different feels in it too. Jones’ music had a clear cut intense sound flowing through the notes from the high ones to the low ones (Lavelle 58). The music played involved gradual crescendo and intensity. The Wrath of the Klan Essay White robes, masks, and conical hats are the definitive appearance of the Ku Klux Klan. Formed post-Civil War, the Klan has stricken fear into many individuals, being America’s first true terrorist group. Today, it is still a prominent organization that is trying to be stopped. The KKK is arguably the most infamous organization of all time because of their hate of non-white/Christian people. The Ku Klux Klan originated in 1865. It was created by six Confederate Army veterans in Pulaski, Tennessee to oppose Reconstruction policies and maintain â€Å"white supremacy† by scaring African Americans (â€Å"The First Ku Klux Klan†). The Klan quickly spread into most southern states and started its reign of terror on blacks, Republicans, scalawags (white Southerners who interacted with Northerners), and carpetbaggers (Northerners that moved to the South) (â€Å"The First Ku Klux Klan†). Common acts used by the Klan during that time were lynchings, whippings, rapes, and tar-and-featherings (â€Å"Ku Klux Klan†). The Klan had a meeting in 1867 to attempt organize itself; General Nathan Bedford became the Grand Wizard in the process (â€Å"The First Ku Klux Klan†). Despite this meeting, the Dens continued to operate independently and became more and more reckless (â€Å"The First Ku Klux Klan†). Forrest ordered for the Klan to be disbanded in 1869, saying that the Klan was being perverted from its original honorable and patriotic purposes, becoming injurious instead of subservient to the public peace. (â€Å"Creation of First Klan†). The first Klan officially ended in 1871, as the government would pass a Force Act to make most of their intimidation tactics federal offenses, thus hindering their actions (â€Å"First KKK†). The Klan would remain inactive for the next few decades. Indeed, in about four decades, the Klan would rise again. The second Klan was founded in 1915 by William J. Simmons (â€Å"The Second Ku Klux Klan†). Compared to its previous incarnation, this Klan was much better organized, such as how it recruited members with membership fees (â€Å"The Second Klan†). This Klan was not just focused on blacks, but Catholics, Jews, and immigrants as well (â€Å"Revival of the Ku Klux Klan†). Their actions were similar to that of the first Klan, frequently using extreme actions on its enemies (â€Å"The Second Ku Klux Klan†). This Klan was the biggest of any Klan during its lifespan, with an estimated 4-5 million members at its peak in the mid-1920s (â€Å"The Second Klan†). However after the Great Depression in 1929, the Klan quickly deteriorated in the 1930s, and by the 1940s it was again finished due to â€Å"internal conflicts, criminal acts done by chapter leaders and external oppositions† (â€Å"The Second Klan†). The Klan was back again during the Civil Rights Movement. During that time, many whites were outraged by the proposed laws of African Americans getting equal rights; therefore, they formed multiple groups throughout the South, calling themselves the Ku Klux Klan (â€Å"The Third Klan†). Violence of these groups was most notable in Birmingham, Alabama, with them bombing and attacking African Americans schools and white activists (â€Å"The Third Klan†). One of the more notable bombings is the bombing of the 16th Street Baptist Church, which killed four children (â€Å"The Third Klan†). These bombings led to the arrest of multiple members of the Klan (â€Å"The Third Klan†). Since the 1970s, the Klan has been weakened by events such as court cases and government infiltration (â€Å"Ku Klux Klan†). To further limit their notoriety, neo-Nazi activity would soon overshadow the Klan by the late 1990s (â€Å"About the Ku Klux Klan†). In the early 2000s, the immigration rates in some communities increased greatly, creating fear of immigration in many Americans (â€Å"About the Ku Klux Klan†). To no surprise, the Klan attempted to use this fear to gain publicity and more members, though they ultimately failed. The Klan is still active to this day, numbering between five thousand to eight thousand members. It is split into â€Å"klaverns†, or small organizations, that are located throughout the United States (â€Å"Present-Day Klans†). These klaverns have increased ever since the election of Barack Obama as president in 2008, hoping to bring back white supremacy (â€Å"Present-Day Klans†). Recently, they have been trying to exploit common issues such as gay marriage and crime (â€Å"About the Ku Klux Klan†). Many people consider their actions to be nothing more than attention-seeking (â€Å"The KKK History†). It is possible that they are waiting for the perfect opportunity to reign supremacy. The Ku Klux Klan will forever live in infamy due to their violent actions. During its existence, the Klan has attacked African Americans, Jews, immigrants, homosexuals, and Catholics. Although it will never be as big as it was in the previous years, many people still fear this dangerous group. Small children have trouble sleeping at night in thought of the Ku Klux Klan’s terrifying actions.

Example of Business Contract 1. Your Relationship with PCFS Solutions. A. Introduction. The sale and performance of Professional Services (defined below) hereunder is subject to the terms of this Professional Services Agreement (the Agreement) between you (hereinafter you or Client) and PCFS Solutions, Inc. and its affiliates (hereinafter PCFS Solutions). PCFS Solutionss sale and performance of Professional Services under this Agreement shall be solely for Clients own internal use and not for resale. B. Definitions. Deliverables means the tangible and intangible materials, including reports, studies, base cases, drawings, findings, manuals, procedures and recommendations prepared by PCFS Solutions or its suppliers, licensors or subcontractors in the course of performing the Professional Services. Materials means all content and other items included with or as part of the Professional Services, Software or Deliverables. Professional Services means the services performed by PCFS Solutions as described in one or more Statements of Work. Software means any software, library, utility, tool, or other computer or program code, in object (binary) or source-code form, as well as the related documentation, provided by PCFS Solutions to you in connection with the Professional Services. Software includes software locally installed on your systems and software accessed by you through the Internet or other remote means (such as websites, portals, the PCFS Solutions Platform, and cloud-based solutions). Statements of Work are separately signed mutually agreed upon documents that outline the scope of the Professional Services, time period for service delivery (including any milestone requirements), requisite service steps, and payment terms. Third-Party Products means any non-PCFS Solutions-branded products, software or services. C. Additional Agreements. This Agreement together with any accompanying Statements of Work, forms a legally binding contract between you and PCFS Solutions in relation to your purchase and PCFS Solutions performance of Professional Services. Each Statement of Work will be interpreted as a single agreement, independent of any other Statement of Work, so that all of the provisions are given as full effect as possible. In the event of a conflict between these agreements, the terms of these documents will be interpreted in the following order of precedence: (1) Statement of Work; (2) this Agreement. D. Payment. I. Payment Terms. Unless otherwise agreed to by PCFS Solutions, payment of invoices must be received by prior to commencement of the Professional Services. Client will pay PCFS Solutions fees for the Professional Services calculated using the rates set forth in the Statement of Work within 30 days after receiving invoice(s) for such fees. Client (1) will reimburse PCFS Solutions for reasonable, actual travel, meals, lodging, and other out-of-pocket expenses incurred by PCFS Solutions in connection with the Professional Services, and (2) will pay or reimburse PCFS Solutions for all taxes, however designated or levied, on the Professional Services or Deliverables provided by PCFS Solutions hereunder. PCFS Solutions further reserves the right to seek collection of all overdue amounts (including by referral to third-party collectors), plus all reasonable legal fees (including reasonable attorneys fees) and costs associated with such collection, and Client agrees to pay the same. III. Taxes. Unless otherwise expressly stated, any fees charged to Client do not include Taxes (as defined below). Client is required to pay any and all Taxes associated with the fees charged by PCFS Solutions (Transaction Taxes), regardless of how or upon whom they are imposed on. These Transaction Taxes exclude income taxes but may include, but are not limited to, local, state, provincial, federal or foreign taxes, levies, duties or similar governmental assessments of any nature, including value added taxes, consumption taxes, Goods and Services taxes, GST/HST, excise, sales, use or similar taxes and any withholding taxes (together Taxes). All amounts invoiced pursuant to this Agreement are payable in full and without reduction for Taxes. If PCFS Solutions has a legal obligation to pay or collect Taxes for which Client is responsible under this section, the appropriate amount shall be invoiced to and paid by Client, unless Client provides PCFS Solutions with a valid tax exemption c ertificate authorized by the appropriate taxing authority. IV. Prices. The prices charged for Software and Professional Services purchased under this Agreement shall be the amounts set forth in the Statement of Work. 2. Scope of this Agreement. This Agreement authorizes you to purchase Professional Services from PCFS Solutions in accordance with one or more Statements of Work that explicitly incorporate this Professional Services Agreement. 3. Confidentiality. In connection with this Agreement, each party may have access to or be exposed to information of the other party that is not generally known to the public, such as Software, Materials, product plans, pricing, marketing and sales information, Client lists, know-how, or trade secrets, which may be designated as confidential or which, under the circumstances surrounding disclosure, should be treated as confidential (collectively, Confidential Information). Confidential Information may not be shared with third parties unless such disclosure is to the receiving partys personnel, including employees, agents and subcontractors, on a need-to-know basis in connection with this Agreement, so long as such personnel have agreed in writing to treat such Confidential Information under terms at least as restrictive as those herein. Each party agrees to take the necessary precautions to maintain the confidentiality of the other partys Confidential Information by using at least the same degree of car e as such party employs with respect to its own Confidential Information of a similar nature, but in no case less than a commercially reasonable standard of care to maintain confidentiality. The foregoing shall not apply to information that (1) was known by one party prior to its receipt from the other or is or becomes public knowledge through no fault of the recipient; or (2) is rightfully received by the recipient from a third party without a duty of confidentiality. If a recipient is required by a court or government agency to disclose Confidential Information, the recipient shall provide advance notice to other party before making such a disclosure. The obligations with respect to Confidential Information shall continue for two years from the date of disclosure. 4. Term; Termination. A. Term of this Agreement. This Agreement shall be effective from the Effective Date and shall continue until it is terminated as set forth below (the Term). B. Termination. Either party may terminate an individual Statement of Work hereunder if the other party commits a material breach of such agreement and the breach is not cured within 90 days of receipt of written notice from the injured party. PCFS Solutions may terminate this Agreement immediately, if (1) you fail to make any payment when due; (2) you are acquired by or merge with a competitor of PCFS Solutions; (3) you declare bankruptcy or are adjudicated bankrupt; or (4) a receiver or trustee is appointed for you or substantially all of your assets. Either party may terminate this agreement with (30) days written notice provided as set forth in Section 9(N). Upon termination of this Agreement, all rights and obligations of the parties under this Agreement and any accompanying Statements of Work will automatically terminate except for rights of action accruing prior to termination, payment obligations accruing pursuant to any Statements of Work, and any obligations that expressly or by implicatio n are intended to survive termination. 5. Proprietary Rights. You irrevocably acknowledge that, subject to the license granted herein or any separate license agreement referenced in Section 8 below, you have no ownership interest in the Software, the Materials, the methods by which the Professional Services are performed or the processes that make up the Professional Services (the PCFS Solutions IP). PCFS Solutions owns all right, title and interest in the PCFS Solutions IP, subject to any limitations associated with the intellectual property rights of third parties. PCFS Solutions reserves all rights not specifically granted herein. 6. Deliverables. Subject to payment in full for the applicable Professional Services, PCFS Solutions grants you a non-exclusive, non-transferable, royalty-free right to use the Deliverables solely in the country or countries in which you do business, solely for your internal use, and solely as necessary for you to enjoy the benefit of the Professional Services as stated in the applicable Statements of Work. PCFS Solutions and its applicable suppliers or licensors will retain exclusive ownership of all Deliverables, and will own all intellectual property rights, title and interest in any ideas, concepts, know-how, documentation and techniques associated with such Deliverables. 7. Suspension or Modification of Software or Professional Services. PCFS Solutions may suspend, terminate, withdraw or discontinue all or part of the Professional Services or your access or one or more users access to the Software upon receipt of a subpoena or law-enforcement request, or when PCFS Solutions believes, in its sole discretion, that you (or your users) have breached any term of this Agreement or an applicable Statement of Work or are involved in any fraudulent, misleading or illegal activities. 8. Software. A. Accompanying License. Software and Materials may be provided subject to a separate software license agreement, product guides, operating manuals or other documentation included with the software or presented to you during the installation or use of the Software. You agree to be bound by such license agreements. B. Software License from PCFS Solutions. If no license terms accompany the Software, then subject to your compliance with the terms set forth in this Agreement, PCFS Solutions hereby grants you a personal, nonexclusive license to access and use such Software only during the term of the Professional Services and solely as necessary for you to enjoy the benefit of the Professional Services as stated in the applicable Statement of Work. I. Restrictions. You may not copy, modify or create a derivative work, collective work or compilation of the Software, and may not reverse engineer, decompile or otherwise attempt to extract the code of the Software or any part thereof. You may not license, sell, assign, sublicense or otherwise transfer or encumber the Software; may not use the Software in your own delivery of managed-services to third-parties or in a service bureau arrangement; and may not use the Software in excess  of the authorized number of licensed seats for concurrent users, sites or other criteria specified in the applicable Statements of Work. In addition, Client may not access the Software or monitor its availability, performance or functionality, or for any other benchmarking or competitive purpose.You are further prohibited from (1) attempting to use or gain unauthorized access to PCFS Solutions networks or equipment; (2) permitting other individuals or entities to use the Software or copy the Software or Professional Services; (3) attempting to probe, scan or test the vulnerability of Software or a system, account or network of PCFS Solutions or any of its Clients or suppliers; (4) interfering or attempting to interfere with service to any user, host or network; (5) transmitting unsolicited bulk or commercial messages; (6) restricting, inhibiting or otherwise interfering with the ability of any other person, regardless of intent, purpose or knowledge, to use or enjoy the Software (except for tools with safety and security functions); or (7) restricting, inhibiting, interfering with or otherwise disrupting or causing a performance degradation to any PCFS Solutions facilities used to deliver the Professional Services. II. Audit. You hereby grant PCFS Solutions, or an agent designated by PCFS Solutions, the right to perform an audit of your use of the Software during normal business hours; you agree to cooperate with PCFS Solutions in such audit; and you agree to provide PCFS Solutions with all records reasonably related to your use of the Software. The audit will be limited to verification of your compliance with the software licensing terms of this Agreement. 9. Additional Terms. A. Limited Warranty. PCFS SOLUTIONS WARRANTS THAT ITS SERVICES SHALL BE PERFORMED BY QUALIFIED PERSONNEL IN A MANNER CONSISTENT WITH GOOD PRACTICE IN THE INFORMATION TECHNOLOGY SERVICES INDUSTRY. IF PCFS SOLUTIONS BREACHES THIS WARRANTY, IT SHALL SUPPLY SERVICES TO CORRECT OR REPLACE THE WORK AT NO CHARGE. THE REMEDY SET FORTH IN THIS SECTION IS CLIENTS EXCLUSIVE REMEDY FOR BREACH OF WARRANTY. PCFS SOLUTIONS WARRANTS THAT IT HAS THE RIGHT TO GRANT THE LICENSES TO THE SOFTWARE LICENSED IN SECTION 8 ABOVE, AND SUCH SOFTWARE WILL SUBSTANTIALLY CONFORM TO THE FUNCTIONAL SPECIFICATIONS AND CURRENT DOCUMENTATION PROVIDED BY PCFS SOLUTIONS. THIS WARRANTY DOES NOT COVER SERVICE NOT PERFORMED OR AUTHORIZED BY PCFS SOLUTIONS (INCLUDING INSTALLATION OR DE-INSTALLATION), USAGE NOT IN ACCORDANCE WITH SOFTWARE INSTRUCTIONS, OR USE OF PARTS AND COMPONENTS NOT SUPPLIED OR INTENDED FOR USE WITH THE SOFTWARE OR SERVICES. EXCEPT AS EXPRESSLY STATED IN THE THIS SECTION 9(A), PCFS SOLUTIONS, (INCLUDING ITS AFFILIATES, CONTRACTORS, AND AGENTS, AND EACH OF THEIR RESPECTIVE EMPLOYEES, DIRECTORS, AND OFFICERS), ON BEHALF OF ITSELF AND ITS SUPPLIERS (COLLECTIVELY, THE PCFS SOLUTIONS PARTIES) MAKES NO EXPRESS OR IMPLIED WARRANTY WITH RESPECT TO ANY OF THE SOFTWARE OR SERVICES, INCLUDING BUT NOT LIMITED TO ANY WARRANTY (1) OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PERFORMANCE, SUITABILITY OR NON-INFRINGEMENT; (2) RELATING TO THIRD-PARTY PRODUCTS; (3) RELATING TO THE PERFORMANCE OF SOFTWARE OR PCFS SOLUTIONSS PERFORMANCE OF THE SERVICES OR WHETHER THE SOFTWARE OR SERVICES ARE SUITABLE FOR HIGH-RISK ACTIVITIES; OR (4) REGARDING THE RESULTS TO BE OBTAINED FROM THE SOFTWARE OR SERVICES OR THE RESULTS OF ANY RECOMMENDATION BY PCFS SOLUTIONS. B. Limitation of Liability. TO THE EXTENT PERMISSIBLE BY LAW, PCFS SOLUTIONS WILL NOT BE LIABLE FOR ANY INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR SERVICES PROVIDED HEREUNDER. EXCEPT FOR YOUR BREACH OF SECTION 1.D.I. OR SECTION 8, OR ANY CLAIM BROUGHT PURSUANT TO SECTION 9(C), NEITHER PARTY SHALL HAVE LIABILITY FOR THE FOLLOWING: (1) LOSS OF REVENUE, INCOME, PROFIT OR SAVINGS; (2) LOST OR CORRUPTED DATA OR SOFTWARE, LOSS OF USE OF A SYSTEM OR NETWORK OR THE RECOVERY OF SUCH; (3) LOSS OF BUSINESS OPPORTUNITY, GOODWILL OR REPUTATION; (4) BUSINESS INTERRUPTION OR DOWNTIME; OR (5) DELIVERABLES OR THIRD-PARTY PRODUCTS NOT BEING AVAILABLE FOR USE. IN NO CIRCUMSTANCES, SHALL PCFS SOLUTIONSS TOTAL LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT EXCEED THE TOTAL AMOUNT PAID BY CLIENT TO PCFS SOLUTIONS UNDER THE APPLICABLE STATEMENT OF WORK. THESE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS SHALL APPLY TO ALL CLAIMS FOR DAMAGES, WHETHER BASED IN CONTRACT, WARRANTY, STRICT LIABILITY, NEGLIGENCE, TORT OR OTHERWISE. THE PARTIES AGREE THAT THESE LIMITATIONS OF LIABILITY ARE AGREED ALLOCATIONS OF RISK CONSTITUTING IN PART THE CONSIDERATION FOR PCFS SOLUTIONSS SALE OF SOFTWARE OR SERVICES TO CLIENT, AND SUCH LIMITATIONS WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITIES. C. Indemnification. PCFS Solutions shall defend and indemnify you against any third-party claim or action that Software, Professional Services or Deliverables (excluding Third-Party Products and open source software) prepared or produced by PCFS Solutions and delivered pursuant to this Agreement infringe or misappropriate that third partys U.S. patent, copyright, trade secret, or other intellectual property rights (Indemnified Claims). In addition, if PCFS Solutions receives prompt notice of an Indemnified Claim that, in PCFS Solutionss reasonable opinion, is likely to result in an adverse ruling, then PCFS Solutions shall, at its option, (1) obtain a right for you to continue using such Software, Deliverables or allow PCFS Solutions to continue performing the Professional Services; (2) modify such Software, Professional Services or Deliverables to make them non-infringing; (3) replace such Software, Professional Services or Deliverables with a non-infringing equivalent; or (4) refund any pre-paid fees for the allegedly infringing Professional Services that have not been performed or provide a reasonable depreciated or pro rata refund for the allegedly infringing Product, Deliverables or Software. Notwithstanding the foregoing, PCFS Solutions shall have no obligation under this Section for any claim resulting or arising from (1) modifications of the Software, Professional Services, or Deliverables that were not performed by or on behalf of PCFS Solutions; (2) the combination, operation, or use of the Software, Professional Services or Deliverables in connection with a Third- Party Product (the combination of which causes the claimed infringement); or (3) PCFS Solutionss compliance with your written specifications or directions, including the incorporation of any software or other materials or processes provided by or requested by you. PCFS Solutionss duty to indemnify and defend under this Section 9.C. is contingent upon: (1) PCFS Solutions receiving prompt written notice an Indem nified Claim, (2) PCFS Solutions having the right to solely control the defense and resolution of such Indemnified Claim, and (3) your cooperation with PCFS Solutions in the defense and resolution of such Indemnified Claim. This Section 9.C. states Clients exclusive remedies for any third-party intellectual property claim or action, and nothing in this Agreement or elsewhere will obligate PCFS Solutions to provide any greater indemnity to Client. You shall defend and indemnify PCFS Solutions against any third-party claim or action arising out of (1) your failure to obtain any appropriate license, intellectual property rights, or other permissions, regulatory certifications, or approvals associated with technology or data provided by you, or associated with software or other components directed or requested by you to be installed or integrated as part of the Software, Professional Services or Deliverables; (2) your breach of this Agreement; (3) any inaccurate representation regarding the existence of an export license or any allegation made against PCFS Solutions due to your violation or alleged violation of applicable export laws, regulations, or orders; or (4) your providing of (or providing access to) Excluded Data (defined below) to PCFS Solutions. Each party shall defend and indemnify the other party against any third-party claim or action for personal bodily injury, including death, to the extent directly caused by the indemnifying partys gross negligence or willful misconduct in the course of performing its obligations under this Agreement. D. Independent Contractor Relationship; Assignment; Subcontracting. The parties are independent contractors. No provision of this Agreement will or shall be deemed to create an association, trust, partnership, joint venture or other entity or similar legal relationship between PCFS Solutions and Client, or impose a trust, partnership or fiduciary duty, obligation, or liability on or with respect to such entities. Neither party will have any rights, power or authority to act or create an obligation, express or implied, on behalf of another party except as specified in this Agreement. PCFS Solutions has the right to assign, subcontract or delegate in whole or in part this Agreement, or any rights, duties, obligations or liabilities under this Agreement, by operation of law or otherwise, provided that PCFS Solutions shall remain responsible for the performance of Professional Services under this Agreement. Otherwise, neither party may assign this Agreement, in whole or in part, without the permission of the other. E. Force Majeure. Neither party shall be liable to the other for any failure to perform any of its obligations (except payment obligations) under this Agreement during any period in which such performance is delayed by circumstances beyond its reasonable control, such as fire, flood, war, cyber warfare, including, but not limited to, Internet-based conflict and attacks on information systems designed to or resulting in the disabling of websites and networks, embargo, strike, riot or the intervention of any governmental authority (a Force Majeure). In such event, however, the delayed party must promptly provide the other party with written notice of the Force Majeure. The delayed partys time for performance will be excused for the duration of the Force Majeure, but if the Force Majeure event lasts longer than 30 days, then the other party may immediately terminate, in whole or in part, this Agreement or the applicable Statement of Work by giving written notice to the delayed party. G. Entire Agreement; Severability. This Agreement, together with any Statement of Work, is the entire agreement between you and PCFS Solutions with respect to its subject matter and supersedes all prior oral and written understandings, communications, or agreements between you and PCFS Solutions. No amendment to or modification of this Agreement, in whole or in part, will be valid or binding unless it is in writing and executed by authorized representatives of both parties. If any provision of this Agreement should be found to be void or unenforceable, such provision will be stricken or modified, but only to the extent necessary to comply with the law, and the remainder of this Agreement will remain in full force and will not be terminated. H. Governing Law. This Agreement, any related Statement of Work, and ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) BETWEEN CLIENT AND PCFS SOLUTIONS, including their affiliates, contractors and agents, and each of their respective employees, directors and officers arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement) any related purchase (a Dispute) shall be governed by the laws of the State of California, without regard to conflicts of law. I. Venue. The parties agree that any Dispute shall be brought exclusively in the state or federal courts located in Orange County, California. Client and PCFS Solutions agree to submit to the personal jurisdiction of the state and federal courts located within Orange County, California, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts. J. Bench Trial. The parties agree to waive, to the maximum extent permitted by law, any right to a jury trial with respect to any Dispute. K. No Class Actions. NEITHER CLIENT NOR PCFS SOLUTIONS SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CLIENTS, OR PURSUE ANY CLAIM AS A REPRESENTATIVE OR CLASS ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. L. Limitation Period. NEITHER PARTY SHALL BE LIABLE FOR ANY CLAIM BROUGHT MORE THAN TWO YEARS AFTER THE CAUSE OF ACTION FOR SUCH CLAIM FIRST AROSE. M. Dispute Resolution. Client and PCFS Solutions will attempt to resolve any Dispute through face-to-face negotiation with persons fully authorized to resolve the Dispute or through mediation utilizing a mediator agreed to by the parties, rather than through litigation. The existence or results of any negotiation or mediation will be treated as confidential. Notwithstanding the foregoing, either party will have the right to obtain from a state or federal court in Orange County a temporary restraining order, preliminary injunction, or other equitable relief to preserve the status quo, prevent irreparable harm, avoid the expiration of any applicable limitations period, or preserve a superior position with respect to other creditors, although the merits of the underlying Dispute will be resolved in accordance with this paragraph. In the event the parties are unable to resolve the Dispute within 30 days of notice of the Dispute to the other party, the parties shall be free to pursue all remedies available at l aw or in equity. N. Scope of Services. Subject to the terms and conditions of this Agreement, Company will perform those services (Services) with respect to the Company products separately purchased by Client (Company Commercially-Available Software) as set forth in one or supplemental document(s) (Statement of Work), attached hereto as Exhibit A and as amended and/or supplemented from time to time by the mutual written agreement of the parties and incorporated herein by reference. A Statement of Work will be, at a minimum, a written document that (i) references this Agreement, (ii) describes the Services to be performed (and if said Services shall include the creation of object code, such object Code is defined herein as Deliverable), (iii) specifies the corresponding rate schedule or other fee information, and (iv) is signed by both parties or is issued by one party and signed by the other party. Company will use commercially reasonable efforts to complete the Services by the applicable dates set forth in the attachment (Target Dates). O. Change Orders. Any changes to the scope of the Services must be made in writing and signed by both parties (Change Order) or if the Change Order is made via email to the other partys designated contact person, the receiving party will have five business days to reject the Change Order. If said rejection is not made within the 5 business day period, the Change Order is deemed mutually accepted. Each accepted Change Order will be incorporated herein by reference and subject to the terms and conditions of this Agreement. P. Execution This Agreement may be executed and delivered by facsimile/PDF and the parties agree that such facsimile execution and delivery will have the same force and effect as delivery of an original document with original signatures, and that each party may use such facsimile signatures as evidence of the execution and delivery of this Agreement by all parties to the same extent that an original signature could be used. IN WITNESS WHEREOF, the parties by their duly authorized representatives have executed this Agreement as of the Effective Date.

Mahtab’s Story, a novel by one of Australia’s best-loved children’s authors – Libby Gleeson, is inspired by true events through the main character Mahtab and her family’s experiences of Overcoming Obstacles. (Introducing your texts) I3. Mahtab’s Story explores Overcoming Obstacles through the character’s events, such as (1) Mahtab being responsible in taking care and protecting her younger siblings, (2) accepting their loss of belongings in order for Mahtab’s family to travel to Australia and (3) being open to Australia’s culture in their life. (Arguments) BODY (FIRST) Point= Example= Technique: Explanation= Overcoming Obstacles: Overcoming Obstacles shows a journey of where an individual is facing serious difficulties in life, and then finds ways to overcome their personal trials. (Thesis) Mahtab being responsible in taking care and protecting her younger siblings 1. Topic Sentence: In Mahtab’s Story, the main character has the expectation of taking care and protecting her younger sibling which she Mahtab is a young girl who has two younger siblings, named Farhad and Soroya. It is her task to make sure that they are safe and entertain them. This is a large responsibility and expectation for a 12 years old girl. ‘Mahtab cuddled her and said, ‘dad would never let anything bad happened to you’. This is an example of direct speech where Mahtab lives up to her expectation as an older sibling by providing care and protection for her sister. 2. T: Kinesthetic Imagery E : This is an example of Overcoming Obstacles as Mahtab had volunteered to give up her beloved Grandmother’s bracelet in order to help her family travel overseas. These are not my people.’ E – At first, Mahtab’s family thought that they will get the opportunity to have a better life and freedom. Overcoming Obstacles is seen as this quote accurately shows how Mahtab’s family escaped Afghanistan though they feel very sad, uncomfortable and unwelcome in Australia; instead of freedom, they are sent to a detention centre. Mahtab’s Story written by Libby Gleeson is based on by true events as the main character experiences of Overcoming Obstacles. Mahtab’s Story shows Overcoming Obstacles through events in the novel, such as Mahtab being responsible in taking care and protecting her younger siblings, accepting  their loss of belongings in order for Mahtab’s family to travel to Australia and being open to Australia’s culture in their life. Mahtab and her family members had seriously faced a lot of difficult challenges throughout them travelling from Afghanistan to Australia without being seen by anyone. This Overcoming Obstacle of what Mahtab and her family faced like Losing everything they got, more expectation from Mahtab and moving to another country are very strong and amazingly accomplished.

He Loved Light, Freedom and Animals and Pneuomconiosis Essay

Both poems are about death and the acceptance of death although are written from different perspectives and are different for the fact that in â€Å"He loved light, freedom and animals† by Mike Jenkins the young boy’s death was quite a shock, but it could have been prevented whereas in â€Å"Pneumoconiosis† written by Duncan Bush the man’s death is inevitable, there is nothing he can do to change it. Both poems also have connection with coalmines. Pneumoconiosis is a disease caught from working down in the mines, and the background of â€Å"He loved light, freedom and animals† is about a mining disaster that happened in Aberfan where a slag heap on the side of a mountain collapsed and engulfed parts of the small town. The first poem I studied was Pneumoconiosis, and as the title suggests, the poem is about the killing lung disease that many coalminers suffered and died from. â€Å"Pneumoconiosis† was renames â€Å"The Dust† by the sufferers because it was mainly caused by inhalation of a lot of dust. The dust would get trapped in the lungs and made breathing difficult, and eventually killed after many years of effecting collier’s lives. Duncan Bush wrote in the form of an old retired coalminer who is slowly dying from the disease. The elderly man is now feeling the effects of the disease more than ever. He shows his feelings towards the disease and reflects to his past. The poor man worked down in the mines for thirty years without realising the fatality of his coughing and breathing difficulties but now he begins to see the truth, he’s now walking at a much slower pace and can not talk as fast and fluent. The constant repetition of the line â€Å"I try not to think about it† gives us the impression that in the back of his mind he cannot help the feeling of ominous foreboding that his life will soon be coming to an end. He is worried about when his death will come but doesn’t want the remainder of his life to be a misery. The opening line, â€Å"This is the Dust† is an introduction to the illness, it simply tells us what the whole poem and the title is about. The second line then describes it as â€Å"Black diamond dust†. It is a good way of describing the dust from the coal, as coal is similar to diamond in many ways. They are both valuable, and a fair amount of coal sparkles, as diamonds do. We understand that the man came from the South Wales valleys; the poet shows this by adding â€Å"boy† at the end of the line and uses informal English to punctuate his accent which symbolizes the location of the industry. It is a personal poem, Darren Bush is writing in the first person as though he is the old man telling his story â€Å"I had thirty years in it†. This is affective because we can relate with his character better by understanding what he is going through and feeling. The man was happy in his work back in the day; he didn’t have the slightest idea that one day working there would lead him to his death. â€Å"A laughing red mouth† He would be covered at work in black dirt, and his mouth would stand out, as it was the only clean part of him. We realize the first symptoms of his illness when he used to â€Å"spit smuts black† but obviously, he was unaware and didn’t realize the cause of his spluttering. The poet uses alliteration to describe the young collier suffering, the hard constant â€Å"s† conveys the way the sound the man made and it stands out. In the second verse, the man continues telling us about the disease he suffers from and points out the fact that he accepts it and he bravely admits he will die with it. The poet cleverly uses the line â€Å"it’s had forty years in me now† which follows the line â€Å"I had thirty years in it†. This shows that he is quite old, because he retired ten years ago. The disease isn’t only affecting his inside; his illness is visible – â€Å"like my blued scars†. The scars are a part of him that won’t go away, he can not erase them. The sufferer tells us how he gets by from day to day and how things have changed since he’s been ill in the third verse. There are a few pauses in the third stanza which conveys the shortness of breath the man has. â€Å"One step at a time; especially the stairs.† It is quite jerky, as I can imagine his breathing and talking would be like. He then goes on to talk about his past and his experiences. His own brother also died of Pneumoconiosis, so he knows what he is facing. He explains that he saw his brothers last moment, which I think is very emotional. Although he seems calm, he must be quite frightened that he will be going through the same thing. He doesn’t want to let the image of his brother that will always be with him scare him. The description the poet uses about the brother’s last moment are very good, and give us a vivid image of how much he struggled – â€Å"worse than a hooked carp drowning in the air†. The last three lines of the poem are very emotional and sad, he emphasises his slow walk and the occasional cough he lets out involuntary by telling people to know him as that man. This shows that the illness has effected him so much, he is different to a lot people when he used to be as healthy as the rest. After reading the poem, I admire the character in the poem because he can handle and accept his death, rather than complain and give up all hope. He is trying to lead his life as normal as possible and trying not to make the last of his life a misery which I respect. Another poem I studied was â€Å"He loved light, freedom and animals†. Mike Jenkins writes as if he is the father and he reminisces and remembers happy memories he shared with his son. He doesn’t believe that his son is dead and in his mind the boy is still as lively as ever. The disaster of Aberfan happened on the 21st of October in 1966. The slagheap was balancing on a mountain overlooking the small village. The flood of waste had slipped and rushed down the mountain shattering homes, farms and the village school, which killed 116 young villagers. Critics say that the disaster should never had happened and young, innocent people’s lives such as the character in the poems son shouldn’t have been lost. The poem contains many good descriptions that create strong images of both the child and the slag heap. This creates a good balance of positive and negative emotion in the poem. The images of the slagheap and the child are a complete contrast to one another; the descriptions of the boy are happy and beautiful foe example â€Å"his eyes gleamed as gorse-flowers do now† whereas the slagheap is described by the use of dark, depressing phrases such as â€Å"tumour on the hillside burst and the black blood coal†. The unpleasant phrase of the tumour growing on the top of the mountain reminds us of illness and gives us the thought people would want to stay as far away from it as possible. But tumours can be detected and defused, like the slagheap, it could have been manually moved but nobody had thought of the consequences until it was too late. The poet refers to the characters son throughout the poem, almost in every stanza which I believe makes the poem very interesting. It also shows that he will always think of his son, and will not give up the happy thoughts. He remembers the things he used to do when he was happiest. His son would be â€Å"in the classroom waving an answer like a greeting†. This emphasises how very enthusiastic and eager the boy was and obviously he was a pupil who enjoyed school, but it was there where he had died. When the poor boy was pulled out, the poet writes that his son must have been â€Å"like a child collier, dragged out of one of Bute’s mines.† A child collier would have been in a very dangerous job, and often lost their lives. They would come out of the mines hurt and covered in black dust but his son wasn’t a collier, he was at school. School is meant to be a safe place, but not for the pupils on the day of the disaster. A good example of a simile in the poem is the one about the son and his mother shown in the last stanza. â€Å"Ears attuned as a ewe’s in lambing.† The connection the boy had with his mother was like no other, his mother can still hear his laugh and like and ewe and a lamb, she was attuned to her son. This is a good way of showing that they were close, and his mother is lost without him. She will always recognize his laugh, and can still hear it clearly in her head. The parents of the boy will always remember him as they last seen him, young, healthy and happy. They will be hearing his â€Å"laughs springing down the slopes† for a long time. Mike Jenkins uses personification in his poem to make it more alive and colourful. An example of him using personification is shown in the fourth verse, he creates a character out of the slagheap when the poet describes it s if it has a â€Å"greedy belly† that ate up all the children and villagers. The tone of the poem is conversational, the father tells us as the reader about his son, and about his son’s death. It’s a dramatic poem, and is very emotional. Both negative and Positive feelings are shown in the poem. Although the theme of the poem is sad, the lines about the boy are happy; they are lines that bring a smile to the reader’s faces. In a way this makes us feel even sorrier for the father and makes it more emotional. The lines about the slag heap are bitter, expressing the father’s feelings towards it. In my opinion, the fact that the poem begins with a line about the grave â€Å"No grave can contain him† and then ends with a line about the grave â€Å"I try to foster the inscription, away from its stubborn stone† is clever. It emphasizes the fact that he is in his grave and will not do the things that were mentioned in the middle of the poem, he will not be â€Å"climbing a tree† again or â€Å"calling out names†. I personally enjoyed reading this poem because I felt I could relate to the father, as it was from a personal point of view and can relate to the loss of someone special. It was very emotional and made me sympathize for the mother and father. It was unfair for the innocent, fragile boy to die in such a horrific accident and it made me angry that people had not thought of the consequences they were facing by putting the slagheap on top of the mountain. Both poems are very successful in creating sad emotions, and also anger and frustration. In He loved Light, Freedom and Animals, anger is created because the boy and his classmates were so young when they died, and they didn’t deserve to have their lives taken away. In Pneumoconiosis, anger is created because the old man had been affected by the dust silently, and is expecting his death. This is very frustrating, as there is nothing we as the reader can do to change what has happened and what is going to happen. In my opinion, He love Light, Freedom, and Animals made the biggest impact to my emotions. As the child was only young, it is easy to relate to, and it makes the reader realize that life can be cut so short, although Pneumoconiosis is also very emotional, as the reader acknowledges the long term effects miners suffer. He has been, and is still fighting bravely but he knows he can’t hold on forever.
